Judge Says Can't Say Pledge in Public Schools

Tip to Drudge.

It's being reported here that a judge has ruled that public schools can't do the Pledge of Allegiance. This why judges matter and why conservatives need to make sure that common sense judges are appointed. Sounds the the tyranny of the judiciary continues.

A Dumb Idea for SCOTUS

CNN.com - Senators urge O'Connor to reconsider retirement - Jul 14, 2005

In a copy of the letter obtained by CNN, Sens. Barbara Boxer, D-California, Mary Landrieu, D-Louisiana, Susan Collins, R-Maine, and Olympia Snowe, R-Maine, urged the 75-year-old jurist to return to the court as the chief justice of the United States to avoid what could be a messy confirmation fight over her successor.

Some of these Senators would be the ones putting up the biggest fight. This is a really silly idea and they need to realize who won the Presidential election. Republicans in the Senate didn't put up much of a fight over the Clintom appointees to the SCOTUS even though they were quite far to the left.

What Breaking The Filibuster Means

This is a big time warning to the Senate Republicans. You have the majority but, if these judges do not get up and down votes, you will lose that majority. I've been disheartened by this effort so far and am running out of patience. Will I still vote Republican, of course, but I guarantee that many conservatives won't. They will give up and either dump caring about politics or will start a third party. We are tired of the RINOs and won't be giving any money to your special funds for re-election. We will not tolerate any more Arlen Spector primaries as they immediately run towards the left, once they are elected. They use us to get elected; they talk the talk but don't walk the walk.

I will always support the more conservative of the candidates between the Democratic and Republican candidates and wouldn't waste my vote on a 3rd party candidate nor would I NOT vote. It's my bet though, that too many conservatives will take a darker path.

Nuke The Filibuster Now

The longer he waits the tougher it will get. The MSM will never help so do it now. If it doesn't pass then at least we can know who to target in the primaries.

The most substantive comments of the rally came from Boxer, who made a number of notable statements in her brief time at the microphone. First, she appeared to endorse the idea of the Senate creating a super-majority of 60 votes for judicial confirmations. Since federal judges enjoy a lifetime appointment, Boxer told the crowd, their confirmation is simply too important to be decided by a mere majority vote. "For such a super-important position, there ought to be a super vote," Boxer said.

The Constitution is not on your side Ms. Boxer. The filibuster junk is not in the Constitution but advice and consent is. How the Senate defines that is all up in the air at this moment.

UPDATE/Clarification: I should have said that the filibuster is not in the Constitution so if the Senate decides to change its' rules then there isn't any harm to our democracy. Boxer and Byrd to not have a Constitutional right to filibuster if the rules change.

UPDATE 2: Instapundit thinks Boxer wants to change the Constitution. A different take than mine but the same basic conclusion. The filibuster is not a guaranteed constitutional right. It would need to be changed.

Hewitt's Take On Specter

It's probably smart to listen to Hugh Hewitt on this Specter issue. If Specter is not going to use a litmus test then he'll probably be OK. He just needs to realize that he's one of 55 and act like it.

This Is Why We Need A Republican President and Senators

A Nebraska judge has issued an injunction against the ban on partial-birth abortions, signed by President Bush today. Since the Democrats can filibuster judicial nominations the Senate cannot approve common sense judges. If you think that your Senator matters, this in one reason. Also, I'm sure that George W. Bush would not mean to appoint a judge like this but Wesley Clark or Howard Dean sure will.
